E.J. Harrison & Son’s has created this Privacy Policy in order to demonstrate our firm commitment to your privacy. The following discloses our information gathering and dissemination practices relating to E.J. Harrison & Son’s websites, mobile applications, the delivery of our services, text messaging communications, and other interactions with you (collectively, the “Sites”).

Please note that this Privacy Policy only applies to those Sites that post a link to this Privacy Policy. When you access external links from E.J. Harrison & Son’s Sites, including any E.J. Harrison & Son’s subsidiary Sites, such external websites may have different privacy policies, and E.J. Harrison & Son’s is not responsible for the privacy practices of such external websites. 1. Personal Information Collection

E.J. Harrison & Son’s may collect personal information, which is information that alone or in combination with other information could be used to identify you. This could include your name, telephone or mobile phone number, e-mail address, date of birth, home or business address, mailing address, service address, or other location from which you use our services.

We may collect this information when you provide it to us, including when you access certain areas of the E.J. Harrison & Son’s Sites that require registration for certain services, submit a form, contact customer service, opt in to communications, request additional information about our services, or otherwise interact with us.

If you decide to purchase our products or services, we and/or our third-party service providers may need to collect certain additional information, such as your credit or debit card number and expiration date, bank routing number, and account number.

Device Information

When you are connected to our services via mobile applications (“apps”), we may collect device-specific information such as your device model, operating system, unique device identifiers, and mobile network information.

We may associate your unique device identifier or phone number with information that you may have used to register for certain services or purchase products. Server logs maintained by us or our third-party service providers may contain information about the services that you have used and your device-specific information.

We may also maintain digital communication logs that track information such as your phone number, calling-party number, forwarding numbers, time and date of calls, duration of calls, and SMS routing information.

We may use your device’s IP address or MAC address to track device-event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request, and referral URL.

When you visit, use, and interact with the Sites, we may receive certain information about your visit, use, or interactions. For example, we may monitor the number of people who visit the Sites, peak hours of visits, which pages are visited, the domains our visitors come from, which browsers people use to access the Sites, broad geographic information, and navigation patterns.

In particular, the following information may be created and automatically logged in our systems:

  • Log Data: Information that your browser automatically sends whenever you visit the Sites (“Log Data”). Log Data includes your Internet Protocol address, browser type and settings, the date and time of your request, and information regarding how you interacted with the Sites.

  • Usage Information: We collect information about how you use our Sites, such as the types of content that you view or engage with, features you use, actions you take, and the time, frequency, and duration of your activities.

Specialized Information

We may collect and store information, including personal information, locally on your device using mechanisms such as browser web storage, including HTML5, and application data caches.

Certain services may include a unique application number in connection with the installation of apps. This number and information, including, without limitation, operating system type and app version number, may be sent to our service providers when you install, update, or uninstall apps.

At other times, E.J. Harrison & Son’s may collect information that cannot reasonably be used to identify you. For example, we may aggregate non-personal information about you and other customers who visit our Sites. Aggregated information will not contain information that can reasonably be linked directly back to you.

2. How E.J. Harrison & Son’s Collects Personal Information

E.J. Harrison & Son’s collects personal information we receive from you and from other sources in connection with the products and services we provide to you.

We may also use tools to collect information about you, your computer access points, mobile devices, and the web browser that you use to connect to our Sites or digital applications.

For example, “cookies” are small text files that we may place on your computer or mobile device when you visit our Sites. We may use cookies to personalize your interactions with our Sites.

You do not have to accept our cookies, and you may set your browser to restrict their use or delete them after they have been placed on your computer or mobile device. If you do not accept or delete our cookies, some areas of our Sites may take more time to work or may not function properly.

E.J. Harrison & Son’s may also collect additional information from your web browser each time you visit one of our Sites. We may collect information about the pages that you visit, the time spent on each webpage or area of the Sites, promotions or advertisements that you click on, and other actions you take while using our Sites.

This information may include your Internet Protocol (“IP”) address, browser type, the time that your browser was used to access our Sites, and the referring website’s address.

We may use Google Analytics, a web analytics service provided by Google, to help us analyze use of the Sites. Information about how Google uses data collected from sites or applications that use its services is available through Google’s privacy resources.

Our service providers may also use other standard web-based technologies to analyze interactions with our Sites. These technologies may include web beacons, pixel tags, and clear GIFs.

These technologies help us ascertain the effectiveness of our products, services, campaigns, and marketing programs; customize services offered on or through our Sites; and determine the best use of Sites content and product and service offerings.

Some of this information, including IP addresses, may be stored on our Internet service providers’ server logs and may be available for extended periods of time.

3. Our Use of Your Personal Information

E.J. Harrison & Son’s may use your personal information to contact you via mail, e-mail, telephone, mobile device, or other communication methods in order to provide information concerning your account, requested services, service schedules, service changes, payment confirmations, customer service matters, special events, new services, or other information or promotions that may be of interest to you where permitted by applicable law and consistent with your communication preferences and consent.

We also use return e-mail addresses to respond to e-mails we receive from you.

We may use your IP address or unique device identification numbers to help protect E.J. Harrison & Son’s and our Internet service providers from fraud, unauthorized activity, and security threats.

If you submit a resume or otherwise seek employment with E.J. Harrison & Son’s, we will use that information in connection with your application for current or future staffing requirements. We may also share your resume or application information with our business partners or affiliates that have staffing requirements for which you may be qualified.

Additional uses of your non-personal and personal information may include allowing us to tailor products and services to your needs, helping us organize and manage our relationship with you or your business, conducting business, providing customer and guest support, performing functions described to you at the time of collection, and enforcing our Sites’ Terms of Use.

We may also use non-personal aggregate information to improve our Sites and our products and service offerings. For example, our Internet service providers may report to us that a particular number of visitors accessed a certain area of our Sites or that a certain number of businesses or individuals completed registration forms in particular areas of our Sites. 4. Text Messaging and Mobile Information

E.J. Harrison & Son’s may provide customers and other individuals with the opportunity to receive text messages regarding our services.

When you provide your mobile telephone number and affirmatively opt in to receive text messages from E.J. Harrison & Son’s, we may use your mobile number to send communications consistent with the consent you provided. These communications may include customer service messages, account notifications, service reminders, service updates, scheduling information, payment-related information, or other communications you have agreed to receive.

Consent to receive text messages is not a condition of purchasing any goods or services.

You may opt out of receiving text messages at any time by replying STOP to a text message. You may request assistance by replying HELP or by contacting E.J. Harrison & Son’s using the contact information provided below.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

Text messaging originator opt-in data and consent will not be sold, rented, shared, or otherwise disclosed to third parties or affiliates for their own marketing or promotional purposes.

The foregoing restrictions regarding mobile information, text messaging originator opt-in data, and consent apply notwithstanding anything else in this Privacy Policy that may permit the disclosure of other categories of personal information.

5. Our Disclosure of Your Personal Information

We do not sell, lease, or license your personal information to third parties.

We may share personal information, other than text messaging originator opt-in data and consent as restricted above, with service providers that provide certain services to us, including, without limitation, website hosting services, payment and credit card processing, order processing, customer service systems, information technology services, analytics, communications infrastructure, and visitor surveys.

We take commercially reasonable steps to ensure that these service providers adhere to appropriate security standards regarding personal information, and we prohibit them from using your information for their own marketing purposes.

For clarity, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties.

E.J. Harrison & Son’s may also disclose personal information as necessary to:

  • Comply with a subpoena, court order, or other legal process;

  • Cooperate with law enforcement or other government agencies;

  • Establish or exercise our legal rights;

  • Protect the property or safety of our company, employees, contractors, vendors, suppliers, and customers;

  • Defend against legal claims;

  • Assist with internal or external investigations; or

  • Comply with other requirements or permissions under applicable law.

We may disclose information to others in connection with the sale, merger, acquisition, financing, or restructuring of E.J. Harrison & Son’s, or in connection with a transaction involving the sale or assignment of some or all of our assets, including during an appropriate due diligence process, subject to applicable legal restrictions.

We reserve the right to provide non-personal information, such as aggregated or de-identified data, to third parties.

6. Data Retention

We keep personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, for as long as we have a legitimate business need to do so, or as required by applicable law, including for tax, legal, accounting, regulatory, or other purposes, whichever is longer.

Text messaging consent and opt-out records may be retained as reasonably necessary to document and honor your communication preferences and comply with applicable requirements.

7. Data Storage and Security

You use the Sites at your own risk.

We implement commercially reasonable technical, administrative, physical, and organizational measures designed to protect personal information, both online and offline, against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

However, no Internet, wireless, electronic storage, or e-mail transmission is ever completely secure or error-free. In particular, e-mail sent to or from us may not be secure. You should therefore use appropriate care when deciding what information to send to us through the Sites or by e-mail.

E.J. Harrison & Son’s is not responsible for circumvention of privacy settings or security measures contained within third-party websites or services outside our control.

8. Children and Data Collection

E.J. Harrison & Son’s Sites are general-audience Sites. E.J. Harrison & Son’s Site content is not directed toward children under the age of 13.

We do not knowingly collect personal information from children under 13. If E.J. Harrison & Son’s or its service providers become aware that a child under 13 has provided us with personal information without appropriate parental consent, we will endeavor to delete that information from our databases.

9. Notice to California Residents

If you are a California resident, please review our Privacy Notice for California Residents for additional information regarding your privacy rights.

Residents of California may also have rights under California Civil Code § 1798.83, commonly known as the “Shine the Light” law, to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes.

As stated above, we do not sell your personal information to third parties.

Furthermore, mobile information will not be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with third parties.

10. Transfer of Information to the United States

If you are located outside the United States, please be aware that personal information you submit, including information provided through our Sites, may be transferred to, processed, or stored in the United States.

The data protection laws in the United States may differ from those of the country in which you are located, and personal information may be subject to lawful access requests from governments, courts, or law enforcement agencies in the United States.

By providing personal information through the Sites, you acknowledge that such information may be transferred to the United States for the uses and purposes described in this Privacy Policy, subject to applicable law.

11. Social Security Protection Policy Statement

E.J. Harrison & Son’s seeks to protect the confidentiality of Social Security numbers (“SSNs”) by maintaining appropriate physical, electronic, and procedural safeguards.

We limit access to SSNs in order to protect against their loss, misuse, or unlawful disclosure. We do not disclose SSNs to third parties except where required or permitted by law.

12. Changes to this Privacy Policy

E.J. Harrison & Son’s may update this Privacy Policy from time to time.

We will notify you of changes by updating the “Last Updated” date at the beginning of this Privacy Policy unless additional notice is required by applicable law.
